4) No professional advice

5) Participation in events, practices, and retreats

By registering for or participating in any event or retreat, you represent that you are able to participate safely, that you will stop if you feel unsafe, and that you will seek medical or mental health support as appropriate. You accept responsibility for your participation and any resulting effects.

Additional terms may apply to specific events and retreats, including waivers, refund policies, safety policies, and community guidelines. Those additional terms are incorporated into these Terms by reference.

6) Donations and payments

Donations, tickets, and other payments may be processed through third-party providers, including Givebutter and its payment processing partners. Your transaction may be subject to those third parties’ terms and privacy policies.

Unless a specific registration page or written policy says otherwise:

  • Donations are generally non-refundable, except where required by law.

  • Event and retreat purchases may have separate refund, transfer, or cancellation terms listed on the relevant registration page or Event and Retreat Terms.

For recurring donations, you can cancel future charges using the method described on the donation page or by contacting us at [contact email]. Cancellation stops future charges and does not retroactively refund prior charges unless required by law or explicitly stated.

We do not provide tax advice. If any donation is tax-deductible, we will describe that on the donation page and/or provide an acknowledgment consistent with applicable requirements.

7) Communications and email updates

If you subscribe to updates or provide contact information, you agree that we may send you communications related to the Services (for example, confirmations, updates, policy changes). You may unsubscribe from marketing emails using the link in the email, but certain transactional messages may still be sent when necessary to provide Services.

You grant Nameless Mountain a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and display your submissions as needed to operate the Services and, if applicable, to promote Nameless Mountain (for example, using a testimonial), unless you request otherwise in writing.

Please do not submit confidential or sensitive information through the Site unless we specifically request it through a secure method.

Testimonials and examples reflect individual experiences. Outcomes vary. No specific results are promised or guaranteed.

The Site may include links to third-party websites or services. We do not control those sites and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk.

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

14) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAMELESS MOUNTAIN AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, FACILITATORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US THROUGH THE SITE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 IF YOU PAID NOTHING, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15) Indemnification

You agree to defend, indemnify, and hold harmless Nameless Mountain and its directors, officers, employees, volunteers, facilitators, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or Services, your submissions, or your violation of these Terms.

16) Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, if we believe it is necessary to enforce these Terms or protect the community, the Site, or others.

17) Governing law and venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any legal action relating to these Terms or the Site will be brought in the state or federal courts located in Boulder County, Colorado, and you consent to their jurisdiction and venue.

18) Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

19) Entire agreement

These Terms, along with any additional terms and policies referenced here (including event-specific terms), constitute the entire agreement between you and Nameless Mountain regarding the Site and Services.
